Thank you for using Masjid Solutions. These Terms and Conditions (“Terms”) govern your access to and use of Masjid Solutions’ websites, software applications, administrative and user portals, mobile applications, kiosks, payment and donation features, communication tools, APIs, and other products and services offered by Masjid Solutions (collectively, the “Services”). These Terms apply to the organizations that subscribe to or use our Services, as well as their authorized administrators, staff, volunteers, teachers, parents, students, members, donors, and other users, as applicable. By accessing or using the Services, creating an account, submitting information or User Content, or otherwise using any Masjid Solutions product or service, you agree to be bound by these Terms, which form a legally binding agreement between you and Masjid Solutions and its applicable affiliates (“Masjid Solutions,” “we,” “us,” or “our”).
You are responsible for maintaining the confidentiality and security of your account credentials, including your username and password, and for activities conducted through your account. You agree to promptly notify Masjid Solutions if you become aware of any unauthorized access to or use of your account.
Our collection, use, and protection of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
We may update these Terms and our Privacy Policy from time to time to reflect changes to our Services, business practices, legal or regulatory requirements, payment processor requirements, or other operational needs. Updated terms will be posted on our website and will become effective on the date indicated in the updated terms. Where appropriate, we may provide additional notice of material changes through the Services, by email, or by other reasonable means.
Your continued use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms.
We may modify, add, restrict, suspend, or discontinue any portion of the Services from time to time. Where reasonably practicable, we will provide appropriate notice of material changes that substantially affect customers’ use of the Services.
We reserve the right to refuse or restrict service, suspend or terminate accounts, and restrict access to any portion of the Services if we reasonably believe that a user or customer has violated these Terms, applicable law, payment processor requirements, or has engaged in fraudulent, abusive, harmful, or unauthorized activity.
The Services, including our websites, software, applications, portals, interfaces, designs, text, graphics, logos, source code, software components, databases, documentation, and other content and technology used to provide the Services, are owned by or licensed to Masjid Solutions and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to these Terms, Masjid Solutions grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Services solely for their intended purposes and in accordance with your organization’s applicable subscription or service arrangement with Masjid Solutions.
Except as expressly permitted by these Terms or authorized by Masjid Solutions, you may not copy, modify, reproduce, distribute, sell, sublicense, publicly display, republish, or create derivative works from the Services or any proprietary Masjid Solutions content.
You may not reverse engineer, decompile, disassemble, attempt to derive or discover source code, circumvent security or access controls, interfere with the operation of the Services, or access portions of the Services for which you are not authorized.
You may not use robots, crawlers, scrapers, data-mining tools, automated scripts, artificial intelligence systems, or other automated methods to access, extract, copy, monitor, or collect content or data from the Services without our authorization. This restriction does not apply to integrations, APIs, automated tools, or other methods expressly provided or authorized by Masjid Solutions, or to generally available search engines indexing publicly accessible portions of our websites in accordance with applicable standards.
The Masjid Solutions name, logos, product names, trademarks, service marks, and other brand features are owned by Masjid Solutions or their respective owners and may not be used without appropriate authorization. You may not remove, obscure, or alter any copyright, trademark, proprietary rights, or other legal notices contained within the Services.
Except for the limited rights expressly granted under these Terms, no right, title, or interest in the Services or Masjid Solutions’ intellectual property is transferred to you. All rights not expressly granted are reserved by Masjid Solutions and its licensors.
You are responsible for your use of the Services and for ensuring that your use complies with these Terms and all applicable laws and regulations.
Masjid Solutions provides software and technology tools to assist organizations with activities such as administration, communications, donations, payments, memberships, school management, event registration, and other organizational functions. Customers remain responsible for the accuracy of information entered into the Services, their organizational and operational decisions, and their compliance with applicable legal, tax, accounting, regulatory, and other requirements.
Masjid Solutions does not provide legal, tax, accounting, or financial advice. Information made available through the Services is provided for general informational and operational purposes and should not be relied upon as a substitute for professional advice when such advice is appropriate.
Certain Services may enable customers to accept donations, tuition, membership fees, registration fees, and other payments. Payment processing is provided through third-party payment processors and is subject to additional terms and requirements, as described elsewhere in these Terms.
Certain Masjid Solutions Services enable Customers to accept and manage payments, including donations, tuition, membership fees, registration fees, event payments, and other permitted transactions.
Payment processing services are provided by independent third-party payment processors, which may include Stripe, Authorize.net, and other payment service providers supported by Masjid Solutions. Masjid Solutions provides software and technology that facilitates access to these payment services but is not a bank, card network, or financial institution.
Customers using payment features are responsible for complying with the terms, policies, and requirements of their applicable payment processor, card networks, financial institutions, and applicable laws and regulations.
Customers are responsible for the accuracy and legitimacy of transactions conducted through their accounts, including applicable refunds, disputes, chargebacks, fees, taxes, and other obligations associated with those transactions.
Payment processors may establish eligibility requirements, transaction limits, reserves, holds, payout schedules, verification requirements, or other restrictions. Masjid Solutions does not control and is not responsible for decisions made by a payment processor regarding authorization, settlement, withholding, suspension, reserves, disputes, chargebacks, or payouts.
Masjid Solutions may restrict or suspend access to payment functionality when reasonably necessary to comply with applicable law, payment processor requirements, or these Terms.
Where payment processing services are provided through Stripe, such services are provided by Stripe and are subject to the applicable Stripe Connected Account Agreement and Stripe Services Agreement (collectively, the “Stripe Services Agreement”), as modified by Stripe from time to time.
By using payment processing services provided through Stripe, the applicable Customer agrees to be bound by the Stripe Services Agreement.
As a condition of Masjid Solutions enabling Stripe payment services, the Customer agrees to provide accurate and complete information about the Customer and its activities and authorizes Masjid Solutions to provide Stripe with information about the Customer and transactions as reasonably necessary to provide the Stripe payment services and comply with applicable requirements.
Customers may use Masjid Solutions and its payment-related Services only for lawful purposes and in accordance with these Terms, applicable laws and regulations, and the requirements of their applicable payment processors and financial service providers.
Customers may not use Masjid Solutions to conduct, facilitate, promote, or receive payments for any business, activity, product, service, transaction, or other activity that is prohibited by the Customer’s applicable payment processor.
Customers engaging in activities classified as restricted by an applicable payment processor are responsible for obtaining any required approval from that payment processor before using the applicable payment services.
Customers may not use the Services for illegal, fraudulent, deceptive, abusive, or unauthorized transactions, money laundering, or other activities prohibited by applicable law or payment processor requirements.
Customers using Stripe payment services must comply with Stripe’s Prohibited and Restricted Businesses requirements and applicable Stripe agreements, as updated by Stripe from time to time.
Masjid Solutions may restrict, suspend, or terminate access to payment functionality if we reasonably believe that a Customer’s activities violate these Terms, applicable law, or the requirements of Stripe, Authorize.net, or another applicable payment processor.
Certain Services require users to create or access an account. You are responsible for providing accurate and current information and for maintaining the confidentiality and security of your account credentials.
You are responsible for activities conducted through your account and agree not to share your login credentials with unauthorized persons. You must promptly notify Masjid Solutions if you become aware of any unauthorized access to your account or any other suspected security breach.
Organizations using Masjid Solutions may authorize administrators, staff, teachers, volunteers, or other individuals to access the Services on their behalf. Each organization is responsible for managing its authorized users, assigning appropriate access and permissions, and promptly removing or modifying access when it is no longer appropriate.
You may not access another user’s account without authorization or attempt to circumvent account permissions, security controls, or other restrictions within the Services.
The Services may contain links to, or integrate with, websites, applications, products, or services operated by third parties. These third-party services are provided for convenience or functionality and are not controlled by Masjid Solutions.
Masjid Solutions is not responsible for the content, availability, security, privacy practices, or operation of third-party websites or services. Your use of third-party services may be subject to separate terms, conditions, and privacy policies established by those third parties.
The inclusion of a link to or integration with a third-party service does not necessarily constitute an endorsement of that third party or its products or services by Masjid Solutions.
Masjid Solutions takes reasonable administrative, technical, and organizational measures designed to protect information processed through the Services against unauthorized access, use, disclosure, alteration, or destruction.
We maintain security measures appropriate to the nature of the Services and the information we process. These measures may include access controls, authentication mechanisms, system monitoring, data backup and recovery procedures, and other safeguards designed to protect our systems and customer information.
Customers are also responsible for maintaining the security of their accounts and for appropriately managing user access, roles, permissions, passwords, devices, and other credentials used to access the Services.
While Masjid Solutions takes reasonable measures to protect information, no method of electronic transmission, storage, or information-security system can be guaranteed to be completely secure. Accordingly, we cannot guarantee the absolute security of information transmitted to, stored by, or processed through the Services.
If we become aware of a security incident involving customer information, we will investigate and respond to the incident and provide notifications as required by applicable law.
Our collection, use, storage, and disclosure of personal information in connection with the Services are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Services, you acknowledge that information may be collected, used, stored, and processed as described in our Privacy Policy.
Customers and users may submit, upload, enter, store, transmit, or otherwise provide information, records, documents, communications, images, and other content through the Services (“Customer Data”).
As between Masjid Solutions and the Customer, the Customer retains all rights and ownership interests it may have in its Customer Data. These Terms do not transfer ownership of Customer Data to Masjid Solutions.
The Customer grants Masjid Solutions a limited, non-exclusive right to host, store, process, reproduce, transmit, display, back up, and otherwise use Customer Data only as reasonably necessary to provide, maintain, secure, support, and improve the Services, comply with applicable law, and fulfill our obligations under these Terms.
Customers are responsible for ensuring that they have the necessary rights, permissions, authorizations, and consents to provide Customer Data to Masjid Solutions and to permit Masjid Solutions to process such data in connection with the Services.
Customers are responsible for the accuracy, quality, legality, and appropriateness of Customer Data submitted through their accounts and for determining which users are authorized to access such information.
Masjid Solutions will handle personal information contained within Customer Data in accordance with our Privacy Policy and applicable law.
Nothing in these Terms gives other customers or users the right to access another Customer’s Customer Data except where such access has been authorized through the Services by the applicable Customer or as otherwise permitted by law.
The Services may allow Customers and authorized users to send or receive communications, including email, SMS/text messages, notifications, announcements, and other electronic communications (“Communications Services”).
Customers are responsible for the content of communications sent through their accounts and for ensuring that they have the necessary rights, permissions, and consents to communicate with recipients. Customers must use the Communications Services in compliance with applicable laws and regulations and the requirements of applicable communications service providers.
Customers may not use the Communications Services to send unlawful, fraudulent, deceptive, threatening, abusive, defamatory, obscene, or otherwise unlawful content; impersonate another person or organization; infringe the rights of others; distribute malware or other harmful content; or send spam or other unauthorized or unsolicited communications.
Masjid Solutions does not routinely review the content of Customer communications. However, we may access, preserve, review, or disclose communications or related information when reasonably necessary to provide or secure the Services, investigate suspected misuse or violations of these Terms, comply with applicable law or valid legal process, or protect the rights, property, or safety of Masjid Solutions, our Customers, users, or others.
We may restrict or suspend access to Communications Services if we reasonably believe they are being used in violation of these Terms, applicable law, or the requirements of an applicable communications service provider.
Masjid Solutions respects the intellectual property rights of others. If you believe that content available through the Services infringes your copyright, you may submit a notice of claimed copyright infringement to Masjid Solutions.

Masjid Solutions may remove or restrict access to allegedly infringing material and may take appropriate action against users who repeatedly infringe the intellectual property rights of others.
Masjid Solutions may investigate suspected violations of these Terms, misuse of the Services, fraudulent or unauthorized activity, security incidents, or conduct that may harm Masjid Solutions, our Customers, users, third parties, or the integrity of the Services.
In connection with such matters, we may preserve, access, or disclose information when reasonably necessary to investigate suspected misuse, enforce these Terms, protect the rights, property, or safety of Masjid Solutions or others, prevent or investigate fraud or security incidents, or comply with applicable law, regulation, court order, subpoena, or other valid legal process. Any handling of personal information will also be subject to our Privacy Policy and applicable law.
We may restrict, suspend, or terminate access to some or all of the Services if we reasonably believe that a Customer or user has violated these Terms, applicable law, or applicable third-party service provider requirements; engaged in fraudulent, abusive, harmful, or unauthorized activity; created a security or operational risk; or used the Services in a manner that could expose Masjid Solutions or others to liability.
Where appropriate and reasonably practicable, we may provide notice and an opportunity to address the violation before suspending or terminating Services. However, we may take immediate action when reasonably necessary to address fraud, security risks, unlawful activity, payment processor or service provider requirements, potential harm to others, or other urgent circumstances.
Suspension or termination of the Services does not limit any other rights or remedies available to Masjid Solutions under these Terms or applicable law.
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. Masjid Solutions makes no warranties or representations, express or implied, regarding the Services, including their availability, reliability, accuracy, security, or suitability for any particular purpose.
Masjid Solutions does not warrant that the Services will be uninterrupted, error-free, or free from harmful components, or that all defects or errors will be corrected. We do not warrant that information or results obtained through the Services will be accurate, complete, or reliable.
To the maximum extent permitted by applicable law, Masjid Solutions disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Certain Services rely on third-party providers, including payment processors, communications providers, hosting providers, and other technology service providers. Masjid Solutions does not warrant the availability, performance, or continued operation of services provided by third parties.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the maximum extent permitted by applicable law, Masjid Solutions and its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or data, arising out of or relating to the Services or these Terms, even if Masjid Solutions has been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the total aggregate liability of Masjid Solutions and its affiliates, officers, directors, employees, agents, licensors, and service providers for all claims arising out of or relating to the Services or these Terms, whether in contract, tort, negligence, strict liability, or any other legal theory, will not exceed the greater of: (a) the total amount of fees paid by the applicable Customer to Masjid Solutions for the Services during the twelve (12) months immediately preceding the event giving rise to the claim; or (b) one hundred dollars ($100).
The limitations in this section apply to the maximum extent permitted by applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities, so some of these limitations may not apply to you.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Masjid Solutions and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) your violation of these Terms or applicable law; (b) your misuse of the Services; (c) Customer Data or other content submitted, transmitted, or made available through your account; (d) your infringement or violation of the intellectual property, privacy, or other rights of any third party; or (e) your activities or transactions with third parties conducted through or in connection with the Services.
Masjid Solutions reserves the right to assume control of the defense of any matter subject to indemnification, in which case you agree to reasonably cooperate with our defense of the claim.
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-law principles. Subject to applicable law, any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Delaware, and the parties consent to the jurisdiction of those courts.
You agree that notices, disclosures, agreements, and other communications that Masjid Solutions provides electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
Nothing in these Terms creates any partnership, joint venture, employment, franchise, or agency relationship between you and Masjid Solutions.
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Masjid Solutions’ failure to enforce any provision of these Terms will not constitute a waiver of that provision or our right to enforce it in the future.
These Terms, together with our Privacy Policy and any additional agreements or terms applicable to specific Services, constitute the agreement between you and Masjid Solutions regarding your use of the Services.
